People always ask me what to wear to court or how do I look innocent.
The experts say that the best color to wear to court is probably navy blue or dark grey. These colors suggest seriousness. At the same time, they do not come with the negative connotations that are often associated with the color black (for instance, some people associate black with evil, coldness, and darkness). However, the short answer is if you are in front of a judge, wear something conservative and non-offensive. The area of my practice is very conservative and religious, so you will have those people on the juries. So when in doubt dress comfortably but conservatively. No matter what you are wearing, if you are constantly fidgeting with your collar or squirming because your pants are too tight, you will not look good to the jury.
As a judge, I would have people who were on trial for DUI's and other alcohol offenses who would wear beer t-shirts and the like to Court. While, I hope that never swayed my mind in any manner, but probably not the smartest to wear. Also, avoid controversial or inuendo type shirts or attire. If you have offensive tattoos, I would suggest that you do your best to cover them up. Remember that the people on the jury may not be a expressive or as hip as you are. Unfortunately, prejudiced people still exist and while as attorneys we work hard to find those and eliminate them from the jury, we only have so many challenges and questions to ask.
Provocative attire for ladies should never be worn and many judges may remove your from the courtroom if you appear that way. Make sure that your skirts and dresses come down below your knees and shirts do not show cleavage. In some courts, the judges will make you put on a prison outfit over your clothes and that is not the best look. Also, who knows who wore that outfit before and when it was cleaned last.
In short, there is no magic piece of clothing or attire that will convince people. However, if ever in doubt, be sure to bring up this issue with the attorney representing you as styles and attire could be different than in my area.
